Terms of Service

1. Agreement to Terms

By accessing or using the AgencyAI platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.

2. Description of Service

AgencyAI provides a platform for consultants and advisors to productize their expertise into AI-powered assessments. The Service includes:

• Assessment template creation and management
• AI-powered report generation with human review
• Customer intake forms and storefront hosting
• Payment processing and order management
• CLI and MCP integration tools

3. Account Requirements

You must be at least 18 years old and have the legal capacity to enter into these terms. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes or to generate harmful, deceptive, or fraudulent content
• Attempt to reverse engineer, decompile, or access the Service through unauthorized means
• Share your API keys or credentials with unauthorized parties
• Use the Service to process personal health information (PHI) without appropriate safeguards
• Interfere with the Service's infrastructure or other users' access

5. Intellectual Property

You retain full ownership of all content you create on the platform, including assessment templates, frameworks, and generated reports. AgencyAI retains ownership of the platform, its source code, and underlying technology.

You grant AgencyAI a limited license to process your content through our AI systems solely for the purpose of providing the Service. Your content is never used to train AI models.

6. Payment Terms

Subscription fees are billed monthly in Canadian Dollars (CAD) via Stripe. Prices are subject to change with 30 days' notice.

• Free trials are available with no credit card required
• Paid plans begin after the trial period ends
• You may cancel at any time; access continues until the end of the billing period
• No refunds for partial billing periods

7. AI-Generated Content

Assessment reports are generated by AI based on your configured frameworks and customer input. You are responsible for reviewing and approving all AI-generated content before delivery. AgencyAI is not liable for the accuracy or completeness of AI-generated output.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AgencyAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. You may delete your account through the dashboard or by contacting us. Upon termination, your data will be retained for 30 days and then permanently deleted, unless otherwise required by law.

10. Modifications

We may update these terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
